Paycheck records include all documents related to your company’s payroll. Federal law requires employers to keep payroll records for three years and payroll taxes for four years. However, depending on your state, you may be required to keep payroll records for up to six years.

Paper records are an option, but they’re cumbersome to organize and store. Storing payroll records electronically is usually a better choice. The best online payroll companies can store your records and even let your employees e-sign documents so that you always have a meticulous paper trail.

We’ll walk you through the different types of paycheck records, state and federal storage requirements, and the different ways your business can manage records to avoid unnecessary employee issues, awkward meetings with your accountant and IRS audits.

What are paycheck records?

Paycheck records encompass all documents associated with payroll. For example, payroll may include onboarding documents, direct deposit authorization forms and pay stubs. Payroll records also include employee personal information, such as whether they’re paid hourly wages or on a salary, pay rates, tax deductions, and benefits.

Why do employers have to keep payroll records?

There are several reasons employers must keep payroll records. First, storing paycheck records can protect your company during an audit or lawsuit. Employees can view records to spot and correct any mistakes proactively or update the company about any changes. Here are some other uses for stored payroll records:

  • Payroll records can be a source to complete business financials and tax returns.
  • Federal and state agencies require storage of paycheck records and are allowed to audit your business and inspect records at any time without notice.
  • Employees can access their payroll records to verify information (required in 22 states).
  • Payroll records serve as a paper trail to support the company if there’s an employee complaint or lawsuit.

Which payroll record items are employers required to keep?

Here are some common payroll record items and their storage requirements:

Fair Labor Standards Act record storage requirements

The Fair Labor Standards Act requires businesses to keep paycheck records and employee information as proof of minimum wages, overtime, equal pay and child labor law compliance. Records should be kept for all nonexempt workers and minimum wage-protected employees. Stored documents can be in paper or electronic form. 

You’ll need to keep basic information, including:

  • Personal employee information
  • Pay rates, along with overtime pay
  • Withholding and deductions (that pertain to gross and net income)

The above records should be kept for at least three years (some have only a two-year requirement).

Consider consulting with legal support services if you have employees who fall into particular categories, such as exempt employees, employees who receive complimentary housing or those who receive remedial education.

IRS payroll record storage requirements

The Internal Revenue Service requires companies to store current employee payroll records for at least four years for tax purposes. Therefore, any forms you use to track employee pay and payroll taxes should be kept, including an up-to-date W-4 form to show withholdings.

The following information is subject to IRS payroll record requirements:

  • Employer tax ID number (EIN)
  • Wage, annuity and pension payments (amounts and dates)
  • Reported employee tips and allocated tip amounts
  • The fair market value of in-kind wages paid
  • Personal employee information, such as full name, home address, Social Security number and occupation
  • Start date for each employee (and end date, if applicable)
  • Sick pay, workers’ compensation and disability insurance information
  • Employee benefits and expense reimbursement
  • Family leave tax credits
  • Work opportunity tax credits
  • Employer and employee contributions to Social Security taxes

Retirement plan record storage requirements

If your company participates in a retirement plan, you must keep an up-to-date record book in case of an IRS audit. This is also helpful when you have to field questions from employees who elect to be a part of the company’s retirement plan offerings. In addition, since retirement plans continuously provide benefits for participants, you’ll need to store records for an unlimited period.

However, general plan documents are only the start. You should also keep the following handy in case an issue arises:

  • Account balances
  • Contributions (amounts and dates)
  • Earnings reports
  • Loans
  • Compensation reports
  • Participant statements (especially those that require a signature)

EEOC and ADEA record storage requirements

The Equal Employment Opportunity Commission (EEOC) requires companies to maintain personal and employment records for one year. If an employee is no longer with the company, recordkeeping requirements call for records to be kept for one year from the employee’s termination date. 

The Age Discrimination in Employment Act (ADEA) requires companies to keep paycheck records for three years. In addition, any benefit plan information must be stored while the plan is in effect and one-plus years after the plan has been terminated.

FYIFYI: While paycheck record laws vary by state, the Small Business Administration recommends keeping paycheck records for six years to keep your business compliant with all employment laws (federal and state).

Additional payroll records you should consider keeping

Along with the employee’s paycheck records, you should keep some other documents on file:

  • Any form that states pay deductions that the employee must authorize, including benefits and retirement plan contributions
  • An employee’s application to work for your company, including their resume or transcript

Should you keep paycheck records longer than required?

Keeping paycheck records for more than the required length of time can actually put employers at risk for security breaches and encourage fraudulent activity. Therefore, all financial and personal employee information, including credit reports, Social Security card images and bank account information, should be destroyed quickly after the retention time frame. 

However, if you receive questions about destroyed documents, it’s wise to keep a list of paycheck record dates and when you got rid of them.

TipTip: If you are unsure how long to keep payroll records, it’s best to consult an attorney before disposing of them. 

Does your state have specific paycheck record retention requirements?

While most states go by the retention requirements set by the IRS and U.S. Department of Labor, a few states have taken additional steps to refine payroll records retention policies. States with exceptions include California, Illinois and New York.

  • California: Payroll records must be kept for six years.
  • Illinois: Payroll records must be kept for five years.
  • New York: Payroll records must be kept for six years.

How to manage and store payroll records

There are three main ways to maintain paycheck records:

  1. Store the files yourself.
  2. Pay a company to store the files offsite.
  3. Invest in payroll software to preserve the files electronically.

TipTip: There are also free payroll services and apps to consider if your business is just starting out or has minimal needs.

Self-storage

While storing paper records in boxes or filing organizers is an option, there are several drawbacks to this method. 

First, most businesses don’t have the capacity to constantly go through the files and may thus end up mixing outdated files with documents that still need to be kept. 

Second, even if the paycheck records are filed correctly, searching for a copy could take time – a luxury you might not have if dealing with a disgruntled employee, your accountant or the IRS. 

Lastly, guaranteeing 24/7 security of paper files is nearly impossible.

Offsite storage

Storing paycheck records offsite does offer benefits over self-storage, including increased security and more office space. However, keeping your payroll information offsite may not be the best option for your business. Here are some cons of offsite storage:

  1. Lack of access. It may be difficult to access documents instantly from an offsite facility. In addition, if your business uses the same forms repeatedly, storing documents offsite could cause a significant pinch point.
  2. Lack of compliance. The document storage facility you choose might not be 100% compliant with federal, state and local laws. Lack of compliance could cause issues with protecting your business’s sensitive information. Additionally, the offsite facility’s temperature and humidity conditions may be a concern when you need to guarantee your documents’ long-term safety.
  3. More expense. Choosing an offsite storage facility that is far from your main office could significantly drive up costs, such as having to pay staff as well as gas and mileage expenses for round trips to drop off and pick up documents.

Manually monitoring paycheck records can sidetrack you from keeping up with other business tasks. Instead, investing in payroll software can help you understand what to prepare, where to store and how long to keep paycheck records.

What Is Tail Coverage in Business Insurance?

You can’t control when a customer makes a claim against your business. There are times the claim is made after a policy’s term ends, such as if you retire or close your company. Tail coverage gives you the protection you need for certain policies – as long as the policy was in force when the claim incident occurred.

What is tail coverage in insurance?

In business insurance, tail coverage – also called an extended reporting period – is an endorsement on an insurance policy for an incident that occurs during the coverage period, but gets reported after the policy expires or is canceled. As an endorsement, there is often an additional fee that you must pay. Tail coverage is found on commercial liability insurance policies that are claims-made policies.

Unlike occurrence-based policies that automatically include coverage for a claim that occurs during the policy period – regardless of when it was filed – tail coverage is a special addition to policies for policyholders concerned about late-filing claims.  

Tail coverage is also different from a retroactive that starts coverage prior to the policy inception date. Retroactive dates extend coverage, while tail coverage extends only the reporting period.

FYIFYI: Tail coverage isn’t needed on occurrence-based policies because the reporting period is indefinite with them.

How does tail insurance work?

Tail coverage gives you peace of mind that coverage for an incident exists after your policy is canceled or lapses. Tail coverage is an important consideration when you anticipate coverage changes. Tail coverage is typical when a business closes, a service provider retires or when a company moves to a new occurrence-based policy.

The way the tail coverage works is simple: It adds a reporting period to the end of your policy term. For example, assume your policy has a term date of Jan. 1 to Dec. 31, 2021, and you request to add tail coverage to this claims-made policy for six months. This means that a claim can be made after Dec. 31, 2021, through June 30, 2022, for an incident during the policy term in 2021. 

Tail coverage doesn’t extend coverage, meaning it won’t cover an incident that happens after Dec. 31, 2021. If an incident does occur and someone files a claim against your business, the claim will be denied and you would be responsible for any losses or damages from that claim.

Did you know?Did you know? A general liability policy usually isn’t a claims-made policy, so you can’t add an extended reporting period or tail coverage to those policies.

Who should consider tail coverage?

Tail coverage should be obtained if you plan to retire or close your business in the foreseeable future. It’s also essential to get this endorsement if you’re switching to an occurrence-made policy.

Consider this example: An accountant is about to retire and has had a claims-made insurance policy from Jan. 1, 2000, to Dec. 31, 2020. The accountant retires and closes his practice as of Dec. 31, 2020, meaning there will be no new potential exposure for a claim from that date. But the accountant can still be sued for work they did in 2018 with a claim filed in early 2021.

Without tail coverage, the accountant would be responsible for all legal and defense fees as well as any settlement or judgment that comes from the lawsuit. With tail coverage, the policy limits kick in and pay for the claim’s defense while handling the settlement costs up to the policy limits.

When it comes to moving to an occurrence-made policy, remember that occurrence-made policies pay only for incidents that happen during the policy period, even though the claim can be reported anytime thereafter. This means that if your business moves from a claims-made policy that ends on Dec. 31, 2020, to an occurrence-made policy, there could be a coverage gap.

Imagine that an incident that occurred in December of 2020 wasn’t reported until February of 2021. The claims-made policy without tail coverage would not cover the incident because it wasn’t reported in the allowable period. The occurrence-made policy wouldn’t cover it because the incident happened before coverage started. 

TipTip: Talk to your insurance agent before your policy’s term end date to determine if you should consider adding tail coverage.

How long should tail coverage last?

There may be gaps in coverage if your tail coverage doesn’t extend for a long enough time period. For example, assume that the tail coverage on your policy ending Dec. 21, 2020, was for six months. This means that claims reporting could happen through June 30, 2021. However, if the insurance claims process began in July of 2021, your company wouldn’t have coverage because the coverage period is over.

To avoid coverage gaps, talk to your insurance representative and legal counsel. Find out what the statute of limitations is in your state for filing claims. Ensure you have tail coverage that lasts as long as the statute of limitations so that you don’t find yourself past the reporting date and uncovered. 

What insurance types offer tail coverage?

You can get coverage on certain types of liability policies. Tail coverage is offered in claims-made insurance policies but not on occurrence-made policies.

These are the most common types of business insurance policies in which you can acquire tail coverage:

Here are some of the most common questions about tail coverage: 

What’s the difference between claims-made and tail coverage?

Tail coverage is a part of a claims-made policy. However, not every claims-made policy has tail coverage. This is an optional coverage usually added by endorsement to the policy. You’ll have to ask for tail coverage, set the coverage length and pay the appropriate premium.

How much does tail coverage cost?

The cost of tail coverage will depend on the insurance type you have and the length of the tail coverage. One example is tail coverage added to medical malpractice insurance, which costs approximately 200% of the expiring premium. This means that a claims-made policy with a premium of $7,500 would require another $15,000 to obtain tail coverage.

Tail coverage is typically added before the policy expires or is canceled. So when you receive your renewal bill or the cancelation notice, you’ll have the ability to add tail coverage. This may be two months prior to coverage termination. If you don’t elect tail coverage before the policy’s cancelation, you may have up to 60 days after the termination to add the coverage. Your insurance carrier will give you details on how to do this.

How do you obtain tail coverage?

As an endorsement, it’s important to make the election for tail coverage: It isn’t added automatically. Talk to your insurance carrier if you are concerned about obtaining tail coverage. Your representative will give you the details about the company’s procedures for adding the endorsement and paying the additional premium.

Is prior acts coverage the same as tail coverage?

A claims-made policy can be modified in two ways: It can extend coverage to prior acts with a retroactive date, or extend the reporting period after the policy ends with tail coverage. Thus, prior acts coverage isn’t the same as tail coverage; they are two different options you can choose with a claims-made policy. You can have one without the other, or you can opt for both.

Is occurrence-made or claims-made better?

Policyholders enjoy occurrence-made policies because they know they will be protected regardless of when a claim arises. However, these policies are generally more expensive than claims-made policies. To maximize cost savings, claims-made policies are the better option.

How can you tell if an insurance policy is claims-made or occurrence-made?

Most policies are occurrence policies. If you have a professional liability, EPLI, or directors and officers policy, you may have a claims-made policy. Because the claims-made policy only covers incidents where the claim is made during the policy period – or a tail coverage period – you’ll want to ask your insurance carrier how your policy is categorized. If there is tail coverage, ask for how long so you fully understand the terms of your coverage.

What are runoff claims?

Runoff claims are similar to tail coverage. It’s something provided for in a claims-made policy that states the insurance carrier remains liable for any claim caused by the policyholder, but made after the termination of the policy. A runoff period is usually longer – up to five years – whereas an extended reporting period or tail coverage often lasts only one year. Additionally, runoff claims are usually found when an insurance merger occurs.

How to use the Forex Historical data App

How to use the Forex Historical data App: https://eaforexacademy.com/software/forex-historical-data/

The Forex Historical Data App is the fastest way to get complete historical data on the market in different formats. You can choose what symbol you want to use. You can select between Forex, commodities, cryptocurrencies, and indices.

Let’s go for EURUSD. After that, you can select the format. If you will use the Forex Strategy Builder, you will need to choose the first CSV option.

For Expert Advisor Studio, you will need the JSON files. For Meta Trader, CSV, and the same for Excel. Let’s load the data for Meta Trader. Fetching data means that the app is preparing the files on the server, and you can see how quickly they are available to be downloaded.

Let’s download the EURUSD for the H1 chart. It downloads immediately, and you have all the data. In this case, from 2007 until the moment, 2020. But before you download the data, you need to synchronize the time zone with your broker.

Click on Settings and choose the time zone according to your broker. The default is GMT. The best practice is to open your Meta Trader and compare the hourly chart.

I will stick to EURUSD, and I will go to the hourly chart. Let’s choose a long visual bar, for example, this one. If I take the crosshair, you will notice that this is on the 13th of July, 2020. And this is the bar at 9:00PM.

Now, I will click on the price chart, and I will look for this bar. It is the one over here. And you can see below right at this field that this is the bar on the same date, 13th of July, 2020, but it shows 6:00PM. So there is a three-hour difference.

What I need to do is to go to Settings, and I will change it to GMT +03:00 no matter which city I take, and I will click on Acquisition one more time, and I will load the data again.

This way, I will synchronize the historical data from the app with my broker, who is an essential first step before you start any algorithmic trading. Click on the price chart, and I will have a look at this long bar. You can see in this field that this is the same bar at 9:00PM, on the 13th of July, 2020.

This way, I have the very same Forex historical data matching the Meta Trader. If you click on Data preview, you will be able to see all the bars that are in this historical data. We have the 4 values, which are the open, the high, the low, and the close, and the volume.

The very same thing that we see on Meta Trader when we put the mouse on the closing of the bars. These values, the open, the high, the low, and the close, they form the candlesticks, and this is how we can get historical data.

Now, most brokers don’t offer a lot of historical data, and it’s tough for the algo traders to do a precise backtest for any trading strategy or Expert Advisor because they lack complete historical data.

Now, if you click on Statistics, you will learn more about the data in this app. First, the Forex Historical Data App was developed by the Forex Software Company. The data is from the Dukascopy broker, which is one of the few brokers providing reliable and complete historical data.

And the data inside the app was converted from tick data into bars data, which makes the app extremely fast, and the data very reliable. There is more information about the asset that I have selected, in that case, it was the EURUSD. And what’s most important is that this historical data has very small gaps, and there are no missing days.

And if I scroll lower, you will see some more information about the Maximum Close – Open, Maximum High – Low, and the Maximum Gap.

Now, having a reliable historical data is the first important thing before you create any strategy for Expert Advisor before you backtest any Expert Advisor or before you spend time developing one.

It is strategic email design that will entice recipient’s to open and engage with your digital marketing campaigns. Understanding how to construct an email and reach your audience is paramount to your success. This guide details everything you need to know, from keeping your brand’s identity consistent through all communications to crafting emails that will improve website traffic as well as conversion and retention rates.

What is email design?

Email design is the strategic process of planning and creating an email for a digital marketing campaign. It aims to improve resonance with a business’s subscribers and its target audience. When sent at strategic moments, a well-designed marketing email can optimize a campaign’s conversion rates. Presentation is a crucial element of digital marketing. Email design is so powerful because it grabs subscribers’ attention by employing the most effective marketing techniques available to e-commerce businesses.

What elements should you include in your email design?

When crafting an email template for new, established or potential customers, there are numerous factors a business must consider. To create an effective email marketing campaign, the email’s formatting and presentation must be thoughtfully designed. Everything from the color scheme to the subject line must be intentionally crafted. Following the best practices below will allow any business to successfully implement an email marketing campaign. 

1. Craft a strategic subject line.

An email’s subject line is the first thing a recipient sees when they get an email notification, and if the recipient views this on a mobile device, the subject line may be the only thing they see, aside from the sender. The subject line should capture the recipient’s attention and inspire them to open the email. A marketable subject line should be too enticing not to open. 

It is important for the subject line of a marketing email to provide value and incentive for the recipient, as this improves the likelihood that the email will be opened. A subject line should also be pertinent to the email’s actual content. By reading the subject line, the recipient should have a clear idea of the email’s purpose.

2. Use an enticing preheader.

Much like the subject line, preheaders are one of the first things a subscriber sees when they receive an email notification. On mobile devices, email notifications often show only the first few dozen characters of an email’s body, so it is important that the preheader is as strategically designed as the subject line. A preheader should not restate the subject line; instead, it should provide insight into the email’s content. The preheader should further describe the benefit offered in the email and contain eye-catching language. 

3. Be concise.

People have short attention spans, and marketing emails have only seconds to convey a message that will inspire the recipient to complete a call to action. A subscriber will be more likely to open an email and follow the directions if the process is easy. Before a subscriber opens an email, they should already have an idea of what it offers. Including a link to a FAQs page and product descriptions on your website reduces the need for extra information in an email. 

4. Stay on brand. 

Brand recognition breeds customer loyalty, and every email your business sends should be consistent in its theme and presentation. Both current subscribers and potential customers should have immediate recognition of your brand’s aesthetic. It is important to be mindful of tone when designing the email’s content. If your brand, website and social media presence have a playful theme, it is best to keep emails light and fun. If your brand is more serious, emails should appear professional, elite and exclusive. 

Color schemes and fonts in marketing emails should coordinate with the business’s logo and its social media presence. The logo should always be bold, visible and recognizable. It is also important that the call-to-action button is easy to spot and relevant to your business. Consistency in presentation will boost conversion rates and help build trust with customers. 

5. Create an intentional layout.

Because attention spans are so short, the layout of a marketing email is just as important as the colors and content. Formatting allows businesses to direct the email recipient’s gaze to the most enticing and important information. Leaving white space is a necessity when presenting information for easy consumption. A provocative image in the correct context can also inspire engagement. 

The organization of the visual content in a marketing email is vital to conversion rates. Where certain words, colors and images appear can influence the likelihood of a recipient’s engagement with an email. Strategic design, such as the placement of a call-to-action button, can make a significant difference in conversion rates. Successful digital marketing campaigns never overwhelm their customers with information, and email design is always done with the user experience in mind.  

6. Be likable and friendly. 

Customization and personalization are proven to improve conversion rates and customer retention. An email recipient is more likely to engage with your business if they perceive your brand as customer-oriented and committed to a positive, genuine relationship. Even if your brand has a more serious or professional tone, including emojis in the subject line or preheader is proven to increase conversion rates and customer engagement. 

Humanizing and personalizing marketing emails is easy with email marketing software such as Constant Contact, Mailchimp and Benchmark. Address emails to recipients by name, appeal to values you share with your customers, express your appreciation for the customer, be authentic, and share information and content that is specifically interesting to certain customer segments. 

7. Use responsive designs.

Designing an email marketing campaign that fits different screens enhances the user experience and demonstrates a brand’s ability to produce high-quality content or products. 

8. Optimize calls to action (CTAs).

CTAs are used to initiate engagement from email recipients. They often appear as big buttons that provide a direct link to signup forms, coupon codes, special offers or personalized content. CTAs should be consistent with your brand’s aesthetic, and they should stand out from the rest of the email’s content. Keep in mind visibility, clarity and enticing the recipient when designing a CTA. In addition to strategic placement, email marketing software is often used to personalize CTAs using segmented audiences.

9. Establish an email signature.

As previously mentioned, the recognition, consistency and likability of a brand are key to its digital marketing success. Email signatures should include the name of your company as well as the identity of the email’s author. It may be beneficial to include the contact information, pronouns, job title and a photo of the employee sending the email; a link to an event calendar or social media accounts; and industry disclaimers (which highlights a brand’s dedication to corporate social responsibility, or CSR). 

10. Include an unsubscribe button.

People appreciate, respect and expect reputable businesses to give their customers autonomy to interact with their digital platforms in a capacity that they dictate. If a customer wants to unsubscribe from your business’s mailing list, the process needs to be clear and simple. 

This is also a legal matter. The General Data Protection Regulation (GDPR) is a law established by the European Union to give individuals control over their personal data, and the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act is a law established by the United States to protect individuals from email spam and regulate marketing sending behaviors. Omitting clear unsubscribe options for customers could impact your compliance with these regulations and result in a fine. Simply include a link at the bottom of every marketing email sent to subscribers to maintain vital legality and customer respect. 

11. Run A/B tests. 

When designing an email marketing campaign, it is important to do your research beforehand and treat the campaign as a dynamic strategy. When deciding how to design and format an email, rely on information collected from current subscribers to guide the creation process. With email marketing services, your business can segment audiences according to their specific interests and test different versions of emails to optimize their marketability. This type of testing is called A/B testing because it tests identical versions of an email with one singular difference. This process will help define the optimal design of your email campaign as you look at results and make changes based on your data. With A/B testing, you can improve many aspects of digital marketing, such as CTAs, color schemes, tone, layout and images.

Hungryroot expertly places its CTA buttons at the top and bottom of this email and uses the space to reiterate the deal offered. The brand is centered and stands out in the white space at the top of the email so that the first thing the recipient sees is the brand. The placement of a beautifully stocked refrigerator helps illustrate what the customer can achieve if they complete the message’s CTA.

This DoorDash email is a great example of a likable, approachable, playful advertisement. The colors and images in the design match the content: DoorDash is now bringing the party to your doorstep. The cheeky rhyme at the top of the email, paired with the message directly below, appeals to the shared values of recipients: “DoorDash now has alcohol. That’s it. That’s the email.” No one likes a ton of promotional emails in their inbox, and if a business does decide to send a message, it should be clearly beneficial to the recipient.

Yelp provides a great example of digital marketing as a tool to build customer trust and provide personalized content. Based on the recipient’s searches on Yelp, the website provides geographically relevant and taste-specific dining options. Yelp asks nothing of its customer in this email. Successful digital marketing always centers on the customer experience and provides value to those who share their email addresses with the company.

Chewy does a beautiful job of personalized product advertisement in this marketing email for a cat owner. Not only does the message present visuals of the cat-related products at Chewy, but it also offers a discount on a product that can improve the recipient’s experience as a pet owner. All cat owners know the litter box is smelly and unpleasant to clean, so they are primed to consider a better option when it comes to their pet’s bathroom. Each product displayed in the email also provides a direct link to the product on Chewy.com, streamlining the purchasing process to encourage customer engagement.

Ticketmaster

Ticketmaster uses an effective preheader in this personalized marketing message that is reiterated in the email’s content and worded to make the reader feel a sense of exclusivity in the offer they are receiving. This offer is not only exclusive, but for a limited time only. This creates a sense of urgency in the email recipient and inspires immediate action. The bolded links at the bottom of the message are also a good example of a business working to comply with digital marketing regulations. The recipient can easily spot where they can unsubscribe, review their terms of use, access privacy policies and learn more about the company. These options are not what the recipient sees first when they open the email, but they are clearly visible if the recipient is looking for that information.
